Introduction
Below you will find our General Terms and Conditions. These always apply when you use or place an order via our Website. The General Terms and Conditions contain important information for you as a buyer. Please read them carefully. We also recommend saving or printing these terms so you can review them again at a later time.
Article 1. Definitions
- Exco Auto's BV: established in Veldhoven and registered with the Chamber of Commerce under registration number 17071563, trading under the name Exco Auto's BV.
- Website: the website of Exco Auto's BV, accessible via https://www.exco.nl/nl/onderdelen and all related subdomains.
- Customer: the customer who, whether or not acting in the course of a profession or business, enters into an Agreement with Exco Auto's BV and/or has registered on the Website.
- Agreement: any arrangement or agreement between Exco Auto's BV and Customer, of which the General Terms and Conditions form an integral part.
- General Terms and Conditions: the present General Terms and Conditions.
Article 2. Applicability of the General Terms and Conditions
- These General Terms and Conditions apply to all offers, Agreements and deliveries of Exco Auto's BV, unless expressly agreed otherwise in writing.
- If the Customer includes provisions or conditions in their order, confirmation or communication that deviate from or are not included in the General Terms and Conditions, these are only binding for Exco Auto's BV if and insofar as they have been expressly accepted in writing by Exco Auto's BV.
- If, in addition to these General Terms and Conditions, specific product or service conditions apply, these will also apply. In the event of conflicting conditions, the Customer may rely on the provision that is most favorable to them.
Article 3. Prices and Information
- All prices stated on the Website and in other materials originating from Exco Auto's BV are exclusive of VAT and, unless stated otherwise on the Website, other government levies.
- If shipping costs are charged, this will be clearly stated before concluding the Agreement and will be shown separately during the ordering process.
- The content of the Website has been compiled with the utmost care. However, Exco Auto's BV cannot guarantee that all information is correct and complete at all times. Prices and other information are subject to obvious programming and typographical errors.
- Exco Auto's BV cannot be held responsible for (color) deviations resulting from screen quality.
Article 4. Formation of the Agreement
- The Agreement is concluded when the Customer accepts the offer of Exco Auto's BV and meets the conditions set by Exco Auto's BV.
- If the Customer has accepted the offer electronically, Exco Auto's BV will promptly confirm receipt electronically. As long as this confirmation has not been received, the Customer may dissolve the Agreement.
- If incorrect data has been provided by the Customer, Exco Auto's BV has the right to suspend its obligations until the correct data has been received.
- Exco Auto's BV may investigate whether the Customer can meet payment obligations and may refuse orders or attach special conditions such as advance payment.
Article 5. Registration
- To make optimal use of the Website, the Customer may register via the registration form/account option on the Website.
- During the registration procedure, the Customer chooses a username and password and is responsible for choosing a sufficiently secure password.
- Login details must be kept strictly confidential. Exco Auto's BV is not liable for misuse. All actions performed via the Customer’s account are the responsibility and risk of the Customer.
- If login details are compromised, the Customer must change the password immediately and notify Exco Auto's BV.
Article 6. Execution of the Agreement
- After receiving the order, Exco Auto's BV will ship the products as soon as possible.
- Exco Auto's BV may engage third parties in executing the Agreement.
- The delivery period is, in principle, 30 days. The method of delivery is at the discretion of Exco Auto's BV.
- If delivery is delayed, the Customer will be informed and may agree to a new delivery date or dissolve the Agreement free of charge.
- The Customer is advised to inspect products upon delivery and report defects in a timely manner.
- Risk transfers to the Customer upon delivery to the specified address, unless agreed otherwise.
- If a product is no longer available, Exco Auto's BV may supply a similar product. The Customer may then dissolve the Agreement free of charge and return the product free of charge.
Article 7. Right of Withdrawal
- This article applies only to Customers acting as private individuals.
- The Customer may withdraw from the distance Agreement within 14 days after receipt of the product, without giving reasons and free of charge.
- The period starts on the day after the Customer, or a third party designated by the Customer who is not the carrier, has received the product, or:
- if the Customer ordered multiple products in the same order: the day the last product is received;
- if delivery consists of multiple shipments or parts: the day the last shipment or part is received;
- for Agreements involving regular delivery: the day the first product is received.
- The Customer bears the return costs. Original shipping costs are not reimbursed.
- The Customer must handle the product and packaging with care during the withdrawal period.
- The Customer is liable for diminished value resulting from improper handling.
- Withdrawal can be done using the model withdrawal form or another clear statement. Products can be returned to:

- Refunds will be made within 14 days after withdrawal using the original payment method.
- Information about the right of withdrawal is clearly stated on the Website.
Article 8. Payment
- Payments must be made via the methods indicated during the ordering process. For post-delivery payment, a 14-day term applies.
Article 9. Warranty and Conformity
- This article applies only to Customers not acting in the course of business.
- Products must meet reasonable standards and legal requirements.
- Manufacturer warranties do not affect statutory rights.
- Complaints must be reported within a reasonable time.
- If valid, products will be repaired, replaced or refunded.
Article 10. Warranty for Business Purchases
- Products must meet normal standards. A minimum warranty of 3 months applies.
- Defects must be reported within 2 days after delivery.
- If valid, products will be repaired, replaced or (partially) refunded.
Article 11. Complaints Procedure
- Complaints can be submitted by phone, email or post.
- Exco Auto's BV will respond within 5 days.
- Consumers may also use the EU ODR platform: http://ec.europa.eu/odr/.
Article 12. Liability
- This article applies to business customers.
- Liability is limited to the purchase amount.
- Indirect damages are excluded.
- Claims must be reported within 30 days.
- No liability applies in case of force majeure.

Article 14. Final Provisions
- Dutch law applies.
- Disputes will be submitted to the competent Dutch court.
- If a provision is invalid, the rest remains valid.
- “In writing” includes email and fax.
